Louisiana handles the transfer of property after someone passes away through a legal process called succession. It's similar to probate, but governed by Louisiana's unique civil law system. Before land can be legally sold by an heir, property typically needs to be transferred through succession first. The complexity and timeline vary depending on whether there's a will, how many heirs are involved, and the value of the estate. A simple succession can move relatively quickly with the right attorney. If you've inherited land and aren't sure whether succession has been completed, we can help point you in the right direction.
Can I sell land in Louisiana before succession is complete?
Usually, succession needs to be complete or substantially underway before a clean title can transfer to a buyer. We've successfully purchased properties where the succession process ran alongside the sale, coordinating with the title attorney and the heirs to get everything properly in order. Can you buy land with a tax lien in Louisiana?
Often, yes. Delinquent property taxes and certain liens can often be resolved at closing (paid out of sale proceeds rather than requiring you to pay upfront). Louisiana's property tax system does have some specific rules around adjudicated property (land that has been taken by the parish for nonpayment of taxes), which can be more complicated. The title attorney we use on every closing will research the full title history and outline options for legally resolving tax liens.
Do you buy heirs' property in Louisiana?
Yes, and it's one of the more common situations we help solve for. Heirs' property is land that has passed informally through a family (often called "generational land" or "family land") without formal succession or title work. It's extremely common especially in rural parishes. The result is often a situation where multiple family members hold an undivided interest in the property, sometimes without even realizing it. Selling heirs' property requires we work through succession, but it's solvable and usually just requires patience and a good title attorney (which we have!).
